A Rome woman, identified as Michelle Malone, was arrested for felony driving while intoxicated (DWI) after crashing her vehicle with a 12-year-old child passenger.
The incident occurred on Sunday, May 19, around 5:15 p.m. Deputies from the Oneida County Sheriff’s Office were dispatched to a property damage motor vehicle accident on Gifford Road in the Town of Vernon.
Upon arrival, deputies found that Malone, 32, had backed her vehicle into a field, damaging it.
The 12-year-old child was in the vehicle at the time of the accident.
After investigating, authorities determined that Malone was intoxicated, with a blood alcohol content of .26, over three times the legal limit.
Malone was taken into custody and charged with several offenses, including:
- Driving while intoxicated
- Driving with a BAC of 0.08 or higher
- Aggravated driving while intoxicated with a BAC of 0.18 or higher
- Felony aggravated driving while intoxicated under Leandra’s Law (child under 15 in the vehicle)
- Endangering the welfare of a child (Class A misdemeanor)
- Four traffic violations
She was processed at the Kurt B. Wyman Law Enforcement Building and released after centralized arraignment.
An order of protection was issued for the 12-year-old child, and Child Protective Services were notified.
The child was handed over to a sober relative. Fortunately, no injuries were reported.
This incident highlights the serious consequences of driving under the influence, especially with a child in the vehicle.
